An entity described as ‘definitely not Dave’ voted yes on three variance approvals before anyone thought to check its credentials

At 7:14 PM on Tuesday, Harlan County Zoning Authority clerk Patrice Wohl called roll for the variance hearing on record as ZB-2024-117, and a voice from seat four responded ‘present’ in what she later described as ‘a register that made my fillings hum.’ By 9:40 PM, nineteen witnesses had signed affidavits. By 9:55 PM, county legal counsel had issued a two-page memo confirming that the meeting’s three approved variances — including a contested rear-setback exemption for a commercial storage facility on Route 9 — remain fully binding under Kentucky procedural code, because the entity in seat four was seated, responded to roll call, and voted on every single motion without abstaining once.

Harlan County Zoning Authority Chair Donna Fettrick confirmed the situation in a statement released Wednesday morning, which I am going to read to you in full because I need you to understand that this is a real document with a county seal on it: ‘The Authority acknowledges that one attendee at Tuesday’s hearing has been identified as non-human in nature. However, per KRS Chapter 100 and the Authority’s own bylaws, quorum requires five of nine seated members to be present and voting. Five members were present and voting. The decisions stand.’ That’s it. That’s the whole statement. No follow-up press conference. No explanation of who put the non-human in seat four or how long it had been coming to these meetings.

What We Know About Seat Four

Witness accounts are consistent in the broad strokes and diverge only in the details that witnesses are typically unreliable about, like color and smell. The entity was approximately six feet tall, wore what multiple witnesses described as ‘a blazer, the gray one, like from Men’s Wearhouse,’ and sat in the chair belonging to Deputy Chair Ronald Kepf, who was out sick Tuesday with what his office is calling a respiratory infection. Whether Kepf is aware his seat was occupied — and by what — is something his office has not responded to my calls about. The entity’s hands, visible when it reached for the microphone to second a motion on agenda item four, are described uniformly by all nineteen witnesses as scaled. One witness, a contractor named Bill Ashe, told me the fingernails were ‘too long and the wrong color, like a November sky.’ I wrote that down exactly.

If you have a variance application currently pending before the Harlan County Zoning Authority, do not assume your approval or denial was made under standard human deliberation. WTC is advising affected parties to consult their attorneys and, separately, to consult someone who knows what a Reptilian Humanoid considers a reasonable rear-setback distance.

The Reptilian Humanoid as a cataloged cryptid type has been documented at the margins of municipal governance before — a 2019 WTC field report out of Grundy County, Tennessee flagged anomalous voting patterns on a water utility expansion — but Tuesday’s Harlan County incident is the first on record where a county authority has affirmatively confirmed the presence and simultaneously declined to void the proceeding. That combination is new. That combination is, frankly, a bureaucratic posture I have never seen, and I have been covering cryptid-adjacent civic events for eleven years.

I reached out to the county attorney’s office to ask one specific question: does ‘present’ in the quorum sense require the present party to be human? I was told someone would get back to me. I was then told the office was ‘reviewing relevant statutes.’ I was then told that I had reached a voicemail box that was full. I am going to keep calling. In the meantime, the storage facility on Route 9 is cleared for construction. Whatever approved it has not been seen since it left the parking lot Tuesday night on foot, moving, per witness Bill Ashe, ‘with real purpose, like it had somewhere to be.’ It did not sign out on the visitor log. There was no car. This report is ongoing.
